Вопрос лоерам. Motion postponed by defendant

If I submitted a motion - all proper and the hearing was scheduled - is it legal for the other party lawyer to postpone it just by making a call to the hearing office, saying that he will be filing a counter motion, but without actually filing anything by the time of the originally scheduled hearing?

The hearing is on Wed, as of today I did not get anything in writing at all.

Not even a response from the defendant to my motion. Defendant ignored the certified mail - I got it returned to sender.

Yes, it's legal to postpone the motion by another party.
U couldn't recieve anything, if they just postponed it.
Simple logic = USPS doesnt work like an ambulet.

Все зависит от суда, штата, дела, судьи и тд, могут перенисти слушания по ряду причин. Если это уголовное дело и человек не явился то будет bench warrant, если гражданское то либо стороны договариваются перенести слушания - stipulation, либо запрашивают adjournment с указанием причины и наконец слушания могут быть перенесенны просто если сторона не явилась. Такое может произойти даже не один раз - зависит от дела от судьи etc. Надо звонить в суд - они обязанны обьяснить какие правила тк это процедурный вопрос.
