Asylees Filing for Permanent Resident Status

Form I-485, Application to Register Permanent Residence or Adjust Status, is used to adjust the status of asylees to that of a permanent resident. Applicants must have been physically present in the United States in asylee status for at least a total of one year prior to filing the Form I-485.

The asylee should file a Form I-485 with the following supporting documentation (in this order):

Fingerprint fee (this fee applies to applicants who are from 14 years of age or older) ?????

-2 photos in an envelope stapled to lower left corner. The name of the applicant and A-number, if known, should be lightly written in pencil on the back of each photo. Details on photo size, etc, may be found in the form instructions.

- Evidence of Asylee Status. Evidence might include a copy of Form I-94 and a clear, readable copy of the letter granting asylum. If alien was initially given conditional asylum, submit evidence to show that the conditions have been removed. See Resistance to Coercive Population Control (CPC) Programs for more information.

-Evidence of one year’s physical presence in the United States. Please keep physical presence evidence to an absolute minimum. Evidence might include a letter of employment, a lease, school enrollment records, or similar documentation, which would cover broad periods of time.

-Proof of any absences from the U.S. since you have been granted asylum. For example: photocopies of pages in refugee travel document or passport.

-Birth Certificate or other birth record

-Proof of any legal name change you have obtained since you were granted asylum status

-I-693 Medical with Vaccination Supplement. Only a civil surgeon designated by USCIS to conduct medical examinations may complete the Form I-693 and the vaccination supplement submitted with it. Call the National Customer Service Center at 1-800-375-5283 to locate civil surgeons (doctors) where you live.

Ты сам все перечислил... все что ты перечислил, то и нужно.
А вообще на сайте www.uscis.gov все написано...

Биометрику вы будете сдавать в любом случае, т.к она действительна только в течении года, вы наверное подумали, что раз вы сдавали отпечатки когда подавили на асайлум, то все... а нет, тут другой кейс и заново все сдается.
Мед.осмотр, а именно форма I-683 сразу вроде не посылается, ее нужно послать, когда они попросят, т.е пришлют вам письменное уведомление, как правило оно приходит почти в тоже время, когда и вызов на сдачу биометрики.

Как это перевести? "Послать тогда, когда попросят, т.е. не сразу, а потом" или "посылать тем, кому это необходимо"?
Мне лоер сказал не прилагать медосмотр, я не прилагал и мою 485-ю приняли в обработку....

Раньще асайлисты вообще не сдавали медицину. Иногда их просили предоставить только 2-ю часть (вакцинация). Так что медицину можно отправить, также можно отправить и форму 325-А (Биографическая Информация). Но в любом случае, ближе к интервью, они попросят выслать обновленную 325-ю и медицину.

Дальше, за приведённой Вами цитатой следует -

Individuals applying for adjustment of status through a USCIS service center.
General:If you are filing your adjustment of status application with a USCIS service center, include your medical examination report with the application, unless you are a refugee.

If you are applying for adjustment of status one year after you were admitted as a refugee, you only need to submit a vaccination supplement with your adjustment of status application, not the entire medical report, unless there were medical grounds of inadmissibility that arose during the initial examination that you had overseas.

Т.е. в обычном порядке надо приложить мед. обследование, если refugee, то надо только справку о вакцинации, т.к. мед. экзамен был пройден до въезда в США (если не попадаете в исключение)

Эта форма была изменена в июле 2006 года. В старой форме были выделены также Asylee, которым предписывалось не посылать форму до особого распоряжения.

Исходя из того, что это требование для Asylee исчезло, следует предполагать, что они должны посылать мед. экзам. на общих основаниях.

Асайли сдавали медосмотр!!! Его просто не нужно было (когда я посылал в 2004 году) отправлять сразу же вместе с основным пакетом документов... а уже потом они прислали писменное уведомление о том, что необходимо пройти медосмотр... и перезаполнить форму G-325 (в случаи если прошло больше года с момента отправки им основного пакета документов.)

Цитата из инструкции в новой версии I-485:
"...When required, submit a medical examination report on the form you have obtained from USCIS.
General:If you are filing your adjustment of statusapplication with a USCIS service center, includeyour medical examination report with the application, <b>unless you are a refugee.</b>"

Т.е они указали что только refugee могут не посылать медосмотр сразу... странно как-то... запутанно все как-то
Самый лучший вариант - это позвонить в INS, повисеть на холде и поговорить с кастомер сервис и узнать у них этот момент... хотя иногда они там сами ничего не знают...

Пример из жизни... мой знакомый послал медосмотр сразу с документами и все равно они ему прислали уведомление о том что им нужно прислать I-683 (медосмотр), и ему пришлось еще раз все это дело слать.
