Hi,
My situation is a bit complicated. And sorry for writing in English, easier I guess. Any way, I have been in U.S. for like ever.... for eight years on F1 visa. Last year I got married to a russian guy. He has an alien number. He applied for change of status like in 2002 (he got his status in 2001), but as we both discovered the immigration lost the application, and now he has to start the process again. I read on the application that if his status had a derivative visa number available for me, I could be applying with him. However, in derivative number application it says that he could apply for it only within two years after receiving alien status, but there is a note that this two year limit could be lifted for humanitarian reasons. I was wandering what that means and if we both have a shot at it. We have been married for more that a year.

Судя по тому, что Вы написали у Вашего мужа гринкарта? Тогда у Вас нет никаких привилегий для жизни в США. Очередь по этой категории около пяти лет и Вы не имеете права всё это время проживать в США.

What is "derivative number application"?
As far as I know, I-485 does not have such limitation.

Anyways, in your situation I suggest that you contact a real immigration lawyer.

В том то и дело что зеленой у него пока еще нету
он подавал на изменение статуса, но документы не могут найти в иммиграции. то есть он еще в статусе беженца. получил статус в 2001.

Тогда ситуация ещё хуже. Вы бы могли получить derivative статус от него, если бы состояли с ним в браке до получения им статуса. Очередь на ГК для Asylee на начало года была на 15 лет. С подписанием Бушем в мае снятия ограничений в 10 тыс. ГК в год для Asylee этот процесс ускорится, но пока неизвестно на сколько. Т.е. иммиграционных бенефитов Вы от его статуса на сегодняшний день не имеете и в ближайшем будущем не будете иметь.
