Он мог проявить обьективность просто выслушав аргумент другой стороны. Это что обычно и делается в подобных случаях.

Есть такие "благодетели", которые рассуждают типа: смотри, я ради тебя сделал исключение из правил, радуйся и благодари меня за это. Когда от меня приняли [motion for reconsidering], чего по их утверждениям не делают обычно, мне дали понять, что я должен быть счастлив. В смысле: никто не остался с пустыми руками. right, thats why when the oposing side showed up, it ceased to be a ex parte, you know since he is there. And i guess the judge desides to have him answer to your motion. Right?

That's not the point. The usual procedure is - yeah, the other side shows up 'cause you are required by the rules to give them 24-hr notice anyway, so it's never "real" ex parte anymore. So the other side is expected to only show up and argue - nobody expects them to write anything on such a short notice. Here, it was weird 'cause he made them wirte the argument out - it's very unusual.
