No, I see it differently. He came across a document in plain view. It talked about him. It was available for anyone to view. I see no violation of anything in printing it out for internal use. Unless their company guidelines provide otherwise.

It doesn't matter how you see it. He can't use that information - plain and simple. If somebody left a document regarding private financial information and he used it, he could go to jail for insider trading. Printing that e-mail is equal to taking a document, that you left on your desk - it's a theft.

It does matter how I see it, because my point is that you can spin it both ways. Your hypo is simply inapplicable. It was NOT a private document and it did NOT contain any sensitive info. It was an email that was staring at him from his computer. It talked about him. He used it only to submit an internal complaint. There is nothing wrong with his behavior unless somebody shows me a specific provision in their company guideline prohibiting what he's done.

Originally Posted by Dantik

Arguing is pointless. I see what he did wrong, you don't. I deal with this every day - data security is a favorite subject of our legal and compliance departments. Your fellow-lawers are "pain in my assholes" (c) Borat.Originally Posted by Манюня

Alex, information accessible from one's computer is not necessarily property of that person. For example, I as a sysadmin have access to everything on y servers, including everybody's e-mails, IM's, data, files and anything else you can think of. According to your logic, I can use it any way I like.Originally Posted by Alex_3112

Dantik, I see your point,
Did he break any rules while accessing this information? I don't think so.Originally Posted by Dantik
Did he have the right to use the printer? I think you.
If we follow your reasoning, anybody can leave a paper on your desk with a message that insults you, your race, your gender, your relatives... you name itAnd there's nothing you can do about it.
Originally Posted by Olli

Financial institutions are paranoid about somebody misusing any of their information. Your relative should have talked to his direct supervisor at his security company. A letter like this is considered a harassment (resident lawers can back me up on this one). Anyway, he's not going to work at that bank - that's a fact, but if his emplyer decides to reprimand him as a result, he can threaten to sue them for harassment.
P.S. What a country - you can sue anybody for anything. :D
