Если адвокат условий контракта не выполнила, взяв деньги, и у вас контракт имеется, деньги вернуть вполне реально. Если она не соглашается выплатить, избегая вас, упоминание о State Bar думаю побудит её обратить на ваше дело внимание.

А что ты имеешь в виду, ты пологаешь юрист может отомстить?
Т.е типа ни один юрист не будет с тобой связываться? Мне кажется, что на то есть Anti-Defamation Law т.е. фny "writers or speakers who knowingly harm others' reputations.".
Хотя может я ошибаюсь, и таким законом трудно воспользоваться.

No, there was no formal deadline. There is a certain number of visas that can be issued each year, but no one knows how many requests will be sent. So, the INS starts accepting petitions on April 1 and works on them. Once they think that the quota will be reached with the petitions they've already accepted for processing, they say, well, everything accepted after a certain date is not even going to be processed.
In the middle of June of this year the INS said that the petitions sent after May 28 would not be considered. And those received on May 28 would be considered or not considered with a 50/50 chance.
But sometimes the quota is never reached at all, so they accept petitions as they come.

So, formally, the lawyer didn't have to send the petition before a certain date. Like I said, formally, she didn't do anything wrong...

Какие права? Лев, Вы же понимаете, что произошло. В чем Вы можете обвинить адвоката? В том, что она не представляла интересы клиетна самым лучшим из возможных способов?

Dear uncle Theodor, allow me to disagree with you.;) His lawyer got paid to process his H-1 visa. He or she should have known the intricacies of filing this kind of petition. The contract between both parties in this instance, as in all others, is in fact a promise to fulfill each other’s duties.

I don’t think his contract with her contains any clause as regards her not being able to act on time and missing a deadline as a result. She failed to act responsibly on her part and she herself knows it full well. That’s why she’s gone into hiding. The young man did what was asked of him timely so she can’t pin this screw-up on him. However, it’s easy to find out when she actually sent his petition. She told him she would do it in April. As luck would have it she obviously didn’t send anything away in April except his hopes of having an H-1.

Aside from the fact that she doesn’t have a good work ethic, however, she took money for something she couldn’t deliver, though in this case it came as a direct consequence of her not being professional.

Doesn’t matter if she knew about the deadline or not. He paid her to get something and he got nothing. Eye for an eye, nothing for nothing. It’s that simple…:-(

That blood sucking vulture just needs to refund his money and be left with exactly what her client got from the relationship - nothing...

Не буду спорить, не силён в дефамации. Однако, если один юрист говорит необоснованно другому юристу не иметь дела с каким либо человеком. Это по моему незаконно.

Ладно, будем по-нашенски...
А новоиммигрантам я хотел бы по секрету сообщить, что в этой стране очень многое делается очень сильно через жеппу. И иной раз, если адвокат не теряет документов, не делает грубейших ошибок в формах и не дает абсолютно неверных советов, то он часто считается очень хорошим адвокатом... :D
