Интересно. У нас кроме иррек. диф. (которые кстати наш штат первый пропионерил этот консепт в начале 70х) есть ещё 6-7 граундс вкл. "адалтери", нетраханье больше года (кажеца), дезёршен и т.п.
A divorce may be granted in Massachusetts divorce law using either "Fault" or "No-Fault" grounds.
Chapter 208: Section 1. General provisions, lists all of the grounds for divorce in Massachusetts:
-adultery,
-impotency,
-utter desertion continued for one year next prior to the filing of the complaint,
-gross and confirmed habits of intoxication caused by voluntary and excessive use of intoxicating liquor, opium, or other drugs,
-cruel and abusive treatment, or,
-if a spouse being of sufficient ability, grossly or wantonly and cruelly refuses or neglects to provide suitable support and maintenance for the other spouse,
or
-for an irretrievable breakdown of the marriage as provided in sections one A and B; provided, however, that a divorce shall be adjudged although both parties have cause, and no defense upon recrimination shall be entertained by the court.

What if my spouse is unable or unwilling to file the I-751 joint petition ?
If you cannot file because your marriage has ended in divorce, annulment or death of your petitioning spouse, or your spouse refuses to join in the filing of the petition, you may apply for a waiver of the requirement to file the joint petition. The waiver request is also filed on form I-751. To qualify for the waiver, you must establish that one of the following circumstances exists:
· Your spouse has died;
· Your marriage was entered into in good faith but ended by divorce or annulment;
· Your marriage was entered into in good faith but your spouse subjected you to battery or extreme cruelty; or
· Termination of your status would cause you extreme hardship
Base don these responses you will be qualified under "the good faith marriage clause" just have your evidence such as photos, joint ownership of property, car etc, if you have kids together have their birth papers ready, also you must have your divorce paper prior to filing your I-751 to remove your conditions ( should you be divorced by then). insurance documents..anything that can establish or stand as evidence that you two lived together and were married in good faith.
Also be sure to consult with a good immigration lawyer shoul dyou have doubts..all this must be done before your time is up to remove your conditions. Please note that this is NOt legal advice just some quick research based information for you~
