Marriage I-130

Hello everybody, my friend is a greencard holder, he got his gc through asylee status.He wants to marry his girlfriend who is in belorussia but he can't go there himself as well so what he can do, in order to submit I-130 they need to be married.They can't marry in neighboring countries like russia or ukraine because both of them are belorussian citizens would you please help with any suggestion.Thank you all.

А в чем спешка то? Даже если они поженяться и он подаст на нее I-130, там очередь для гринкард холдеров лет на шесть-семь. Т.е. она НЕ сможет попасть на территорию США (с зафайленной I-130) по любой неиммиграционной визе пока он не получит гражданство + еще где-то год.

Has his girlfriend attempted to apply for B-2 visa? If granted, they can always get married in the USA and proceed with I-130 (and concurrent I-485) according the common routine.

Otherwise, the best way would be to get married in a third country and to apply for V-1 visa.

BTW, what's the deal with Russia or Ukraine not marrying citizens of other countries??? In the USA, any nationals can get married (as long as they are not close relatives). And in three States - even same-gender couples, though due to the infamous Marriage Defense Act their marriage is not Federally recognized.

Как мне объяснила в свое время моя Immigration Attorney, I-130 и I-864 подает спонсор (в данном случае spouse), а I-485 -applicant. И неважно, гражданство ли у спонсора или permanent residency - супруга(у) или unmarried child under 21 может спонсировать и тот, и тот! Это вот родителей и прочих близких родственников - только Гражданин США.

В том-то и дело, что НИКАКОГО! Не положены same-sex couples иммиграционные бенефиты. А вот гетеросексуалам - поженились, и спонсируйте на иммиграцию. Несправедливо, но... Это ЗА пределами США, надо полагать (мне дали за 6 месяцев). Тогда I-498 does not apply; она предназначена тем, кто willing to adjust their status within the USA
