    Still, it would be quite a stretch to file a law suit immediately.
    Most likely, the HR will reprimend/consult him first before a further action can be taken.
    But you can always try....

    Standing means having a legally protected interest in the subject matter of the lawsuit. Example: Suppose I walk down the street and see a car run over a little boy. I cannot sue the driver of the car for the child's injuries, because none of my own legal interests were implicated. The fact that I was in the zone of the accident does not matter. An employee has a legally protected interest in (1) being paid; (2) not being discriminated against on prohibited bases; and (3) having the terms and conditions of employment which comply with applicable laws. However, an employee does not have a legally protected interest in having his fellow employees do a good job for the company or in having his employer not discriminate against other applicants.
