I equate the state of mind of one willing to commit murder with the state of mind of one willing to commit murder and availing himself of the opportunity to do so. External circumstances beyond the person's control which either do or do not permit him to satisfy his urges do not change the urges themselves; they do not, without more, alter mentality. We are talking about objective reality here -- not about the quantum of proof necessary convict someone of murder in the court of law.

I want to be an opera singer (state of mind). if only i was given a chance, I would bravely sing off the Madison garden stage or metropolitan opera house (availing himself of the opportunity to do so). but nobody wants to hear me sing, even for free and nobody lets me on the stage (External circumstances beyond the person's control). But it's hard to be an opera singer without an opera (do not permit him to satisfy his urges). In my mind, I am an excellent opera singer, I practice every day in the shower and on the way to work (objective reality). Question: am I an opera singer? Am I a murderer? :smoke:

These are two completely different things. As we previously discussed: it is the state of mind and the act of killing which make one a murderer -- not the fact of getting caught and convicted.

This analogy is misplaced. Murder is defined as the act of killing (which Che did) with the state of mind intending to kill (which Che had). Singing, by contrast, is a purely physical act.
