The Supreme Court on Friday reinstated the death penalty sentence imposed on Boston Marathon bomber Dzhokhar Tsarnaev, reversing a lower federal appeals court ruling which had voided that punishment.
In its 6-3 ruling, the Supreme Court rejected arguments by Tsarnaev’s lawyers that his trial judge erred in barring certain questions to prospective jurors, and evidence of his brother Tamerlan’s role in a prior triple murder.
“Dzhokhar Tsarnaev committed heinous crimes,” Supreme Court Justice Clarence Thomas wrote in Friday’s majority opinion.
“The Sixth Amendment nonetheless guaranteed him a fair trial before an impartial jury. He received one. The judgment of the United States Court of Appeals for the First Circuit is reversed,” Thomas wrote.
All six of the court’s conservatives voted to reinstate the death penalty, while the three liberal justices all dissented.
Prosecutors had called the April 15, 2013, Boston bombings “one of the worst domestic terrorist attacks since the 9/11 atrocities.”
Three people, including an 8-year-old child, were killed and hundreds were wounded when two pressure-cooker bombs filled with metal shrapnel detonated near the crowded marathon finish line.
Dzhokhar, who was 19 at the time, and his older brother Tamerlan fled the scene, kicking off a four-day manhunt during which Massachusetts Institute of Technology Police Officer Sean Collier was shot dead.
Tamerlan died in a gunfight with police in Watertown, Mass.
An injured Dhzokhar, who ran over his brother as he drove away in a stolen Mercedes, was found hours later hiding in a boat parked in a nearby backyard.
A jury in federal district court in Massachusetts convicted Dzhokhar Tsarnaev on 30 counts, and recommended the death penalty for six of them.

Американская военщина займется ЛунойNASA Begins Assembly of Europa Clipper Spacecraft.
When it’s fully assembled, NASA’s Europa Clipper will be as large as an SUV with solar arrays long enough to span a basketball court – all the better to help power the spacecraft during its journey to Jupiter’s icy moon Europa. And just about every detail of the spacecraft will have been hand-crafted.
The assembly effort is already underway in clean rooms at the agency’s Jet Propulsion Laboratory in Southern California. Now, engineering components and science instruments are beginning to stream in from across the country and Europe. Before year’s end, most of the flight hardware – including a suite of nine science instruments – is expected to be complete.
"Until now, the United States space mission extended 22,000 miles above Earth," a narrator says in the video. "That was then, this is now. The Air Force Research Laboratory is extending that range by 10 times and the operations area of the United States by 1,000 times, taking our reach to the far side of the Moon into cislunar space."
The US military had previously talked about extending its operational domain, but now it is taking action. It plans to launch a satellite, likely equipped with a powerful telescope, into cislunar space. According to the video, the satellite will be called the Cislunar Highway Patrol System or, you guessed it, CHPS.
