Should bomber suspect get a lawyer?

For now, the government is invoking the public safety exception, a designation that allows investigators to question Tsarnaev without reading him his Miranda rights, a Justice Department official told CNN on condition of anonymity.

In ordinary cases, a suspect is told by police he has the right to remain silent and he has the right to a lawyer.

But this is not an ordinary case, say U.S. Sens. John McCain and Lindsey Graham.

They urged that Tsarnaev be held as an "enemy combatant," a designation that allows a suspect to be questioned without a lawyer and without being informed of his Miranda rights.

"Now that the suspect is in custody, the last thing we should want is for him to remain silent. It is absolutely vital the suspect be questioned for intelligence gathering purposes," the senators said. "Under the law of war we can hold this suspect as a potential enemy combatant not entitled to Miranda warnings or the appointment of counsel."

Alan Dershowitz, a prominent defense attorney and Harvard law professor, scoffed at the senators' statement.

"Impossible. There's no way an American citizen committing a domestic crime in the city of Boston could be tried as an enemy combatant," he told CNN's Piers Morgan. "It could never happen. And that shows absolute ignorance of the law."

Dershowitz also said statements made by police in Boston seems to contradict the government's reasons for invoking the public safety exception.

2011 Request for Information on Tamerlan Tsarnaev from Foreign Government

    Washington, D.C.
    April 19, 2013

    FBI National Press Office
    (202) 324-3691

The two individuals believed to be responsible for the Boston Marathon bombings on Monday have been positively identified as Tamerlan Tsarnaev, now deceased, and Dzhokar Tsarnaev, now in custody. These individuals are brothers and residents of Massachusetts. Tamerlan Tsarnaev was a legal permanent resident and Dzhokar Tsarnaev is a naturalized U.S. citizen. Charges have not yet been filed against Dzhokar Tsarnaev and he is presumed innocent.

Tamerlan Tsarnaev, age 26, was previously designated as Suspect 1, wearing a black hat. Dzhokar A. Tsarnaev, age 19, was designated as Suspect 2, wearing a white hat. Both were born in Kyrgyzstan.

Once the FBI learned the identities of the two brothers today, the FBI reviewed its records and determined that in early 2011, a foreign government asked the FBI for information about Tamerlan Tsarnaev. The request stated that it was based on information that he was a follower of radical Islam and a strong believer, and that he had changed drastically since 2010 as he prepared to leave the United States for travel to the country’s region to join unspecified underground groups.

In response to this 2011 request, the FBI checked U.S. government databases and other information to look for such things as derogatory telephone communications, possible use of online sites associated with the promotion of radical activity, associations with other persons of interest, travel history and plans, and education history. The FBI also interviewed Tamerlan Tsarnaev and family members. The FBI did not find any terrorism activity, domestic or foreign, and those results were provided to the foreign government in the summer of 2011. The FBI requested but did not receive more specific or additional information from the foreign government.

The elder brother was shot in the battle and collapsed. As his brother lay on the street, Dzhokhar Tsarnaev jumped into the car and took off, plowing past a line of police officers who fired furiously. As he drove, he ran over his brother’s body. Dzhokhar Tsarnaev abandoned the car nearby and fled on foot, triggering an enormous search and setting the region on edge.
