In New York, for most occupations, overtime must be paid at one and one-half times the employee's regular rate for working time over 40 hours in the week. For residential employees, overtime rate applies after 44 hours. Employees who are exempt from state minimum wage requirements are also exempt from overtime requirements.

Effective July 1, 2009, under the New York Labor Law, a health care provider can not require a professional nurse or licensed practical nurse to work more than the nurse's regularly scheduled work hours, except under certain specified conditions, namely, where there is an unexpected health care disaster, or if there is a county, state or federal declaration of emergency; or where the health care employer determines there is an unforeseen emergency affecting safe patient care, and efforts were made to have overtime covered on a voluntary basis; or where necessary to complete an ongoing medical or surgical procedure in which the nurse is actively engaged. This law does not prevent a nurse from working voluntary overtime. Under the New York Education Law, the refusal of a registered professional nurse or a licensed practical nurse to work beyond his or her regularly scheduled hours of work does not solely constitute neglect or patient abandonment, except in certain specified situations.
