The Ins and Outs of Charitable Deductions
By JAN M. ROSEN
OLD CLOTHES AND HOUSEHOLD GOODS For many families giving last year’s clothing and toys or household items to a school or parish rummage sale has long been a triple winner. They got rid of clutter, helped a worthy cause and claimed a tax deduction for the fair market value of the items — or often for far more than fair market value, Congressional critics maintained. So now deductions are allowed only if the items are in good or better condition, but the law does not define good condition. Tax professionals say that while deductions are valid for good used items, they expect more scrutiny from the Internal Revenue Service.
Donna LeValley, a tax lawyer who is a contributing editor of “J. K. Lasser’s Your Income Tax 2007,” recommends that donors take photographs of their contributions and keep a detailed list. Then, if audited, they will have evidence to back up their deductions. With digital cameras and computers, these records can be stored easily, she noted. She suggested a Salvation Army Web site, satruck.com/valueguide.asp, to find help in determining items’ values.
