Proposed High Volume For Hire Service Congestion Rules.

TLC is proposing rules that will continue the*pause on the issuance of new for-hire vehicle (FHV) licenses*for an additional year after the current pause legislation is set to expire.* TLC is also proposing rules that will require High-Volume For-Hire Services to use their drivers more efficiently.

Under the proposed rules, wheelchair accessible vehicles will continue to be eligible to become licensed as a For-Hire Vehicle if they meet TLC’s vehicle requirements.* A new exception is being added for fully battery-electric vehicles. Please note that battery-electric vehicles*do not include hybrid vehicles.*Only vehicles without an internal combustion engine can be licensed under the battery-electric vehicle exception. Following the one-year period, TLC will review and determine, every six months, the total number of new FHV licenses that will be issued in the following six months, if any.*

The proposed rules also seek to increase the efficiency of High-Volume For-Hire Services (Uber, Lyft, Via, Gett/Juno) through a reduction in cruising time. *Cruising time refers to the period of time drivers spend without a passenger. High-Volume For-Hire Services will be required to keep their cruising time in the Manhattan Core at or below 31% from 6 AM to 11 PM Monday through Friday and from 8 AM to 11 PM Saturday and Sunday in Manhattan south of 96th*Street. Going forward, to comply with this requirement large app companies will need to use drivers’ time more efficiently in the Core. This requirement should reduce congestion in the Manhattan Core and reduce the amount of time drivers spend cruising in the Core without a passenger.

Do you currently own a TLC-licensed For-Hire Vehicle?* The proposed rules will NOT impact your existing vehicle license.* You can renew your license and replace your current car with any new vehicle that meets TLC’s vehicle requirements.* The proposed rules will only impact someone who does not currently have a For-Hire Vehicle license and wants to apply for a*new*FHV vehicle license.

Are you applying for a new FHV vehicle license?* If approved, the proposed rules will allow you to apply for and get a new FHV vehicle license only if your vehicle is either*wheelchair accessible*or*battery electric. The battery-electric vehicle exemption*does not include hybrids(battery-electric vehicles are vehicles only powered by electricity and that do NOT have a gasoline engines. Hybrid vehicles are NOT battery-electric vehicles).

Do you own a yellow taxi, commuter van or paratransit vehicle?**The proposed rules will NOT impact your vehicle license.* This will only impact applications for new*FHV*vehicle*licenses.*
