The situation is the following: we had an auto loan.
My husband retired from US Army and we had very bad transition between the jobs. So we didn't make any payments on the loan for 4 months (from November 2004 to March 2005) - we had really tough time with money.
My husband found a good job in March, so as soon as we could - his first paycheck in April’05 - we made a big payment that covered all the missing payments plus all the late fees on the loan. In May we've made a regular payment. So, we caught up on payments completely in April.
From December 2004 we hadn't received any bills, notes of reposition of the vehicle, no mail at all from the company, who gave us the loan.
Last Friday our car was taken away by the company (repossessed). We called the company, the customer service gave us the phone number to call - "All you need is to re-activate your loan" (we didn't even know, that the loan was closed in December 2004). We call that number and the lady on the other side was very rude and she said that she is not going to reactivate the loan. My concern is that they accepted money although the loan was closed and we kept making payments - they didn't even notify us that the loan is closed.
Can we return those 2700 and April's and May's payments based on the reason that the loan was closed already at the time, and the company didn't have a right to accept payments on the car anymore. The thing is that we are now without transportation and we have a son of 4 years old, and I am pregnant (6 months). I would rather buy a car for those 27 hundred, so I can at least go to the doctor. I am very worried and I think that the company didn't have the right to accept payments on the car they were going to repossess. Please, give me an advice - what to do?
