Не знаю как где, но в США могут звонить и спрашивать (я не про консульских работников говорю, а вообще). В таких случаях HR просто просят разрешение у самого работника раскрыть эту информацию.
Если работник знает что происходит, то в чем проблема собственно? Если нада проверить, они будут проверять. Не ответят им, минус вам

Я нахожусь out of F-1 status for many years. Мне 24 года. Я женился
на гражданке США. Она 100% Irish, 26 лет, имеет двоих детей 5 и 7 лет ребятам.
Вопросы:
1) Т.к. моя жена не имеет годовой доход равный 125% of poverty line, что
составляет 27.563$ для семества из 4 человек, она собирается
использовать assets(bank statement).

В какую категорию попадаю я : assets equal 3 or 5 time of the difference?
2) Они просят bank statement за последнии 12 месяцев.
Почему аж за 12 месяцев?
3) Если она сделает deposit на нужную сумму (3 or 5 times of difference)
, но в течении последних 12 месяцев у нее не было оборота крупных
денежных средств на счету, будет ли это достаточто, чтобы
удовлетворить uscis?
4) Может ли кто посоветовать адвоката в Tri-State area , который бы помог
в оформлении документов?

1) Будет ли мне трудно доказать bona fride marriage в моей ситуации
(у нас по любви). Мне 24 и я вне статуса , ей 26 citizen , имеет 2 детей
и была замужем только один раз(разведена).

An Overview of the Process:
Once the marriage has taken place, the couple files the following with USCIS:
1. Petition for Alien Relative (USCIS Form I-130)
2. Application to Register Permanent Residence (USCIS Form I-485)
3. Biographic Information (USCIS Form G-325A)
4. Affidavit of Support (USCIS Form I-864)
5. Permission for Work Authorization (Optional) (USCIS Form I-765)
6. Medical Examination Results (USCIS Form I-693)
7. Request for Travel Documents (Optional) (USCIS Form I-131)
8. The appropriate supporting documents
9. The USCIS filing fees ($1,010 to $1,365).
The USCIS will contact you first regarding the Biometrics / Fingerprinting Appointment.
The USCIS will then issue the work authorization and permission to travel approximately 90 days after filing.
The USCIS will contact you next to schedule an interview. This will be anywhere from 6 months to 9 months after filing the initial application.
Following a successful interview, the foreign national spouse will receive a stamp classifying him/her as a Conditional Permanent Resident.
