If I submitted a motion - all proper and the hearing was scheduled - is it legal for the other party lawyer to postpone it just by making a call to the hearing office, saying that he will be filing a counter motion, but without actually filing anything by the time of the originally scheduled hearing?
The hearing is on Wed, as of today I did not get anything in writing at all.
Not even a response from the defendant to my motion. Defendant ignored the certified mail - I got it returned to sender.
