Здрасте!
Просмотрел форум но ответа не нашел.Может кто поможет?
Можно ли найти работодателия,который оформит разрешение на работу,находясь в Англии?
И проще ли здесь будет пройти посольство?

Да хоть в Африке, если ты подходишь. А для H1B-ков, если есть на руках все необходимые документы, проблемы в посольстве бывают очень редко. Даже в Москве.

Если у вас есть ПМЖ в Англии и соответственный опыт работы, то ваша задача упрощается.
Если же вы просто находитесь на территории Англии--чисто география никаких преимуществ вам не даст...

Прежде всего Вам необходимо найти работодателя, который буде "воевать" за Вас. Т.е. он должен доказать что Вы - "единственный и неповторимый", что Вас некем заменить в США. Это дело трудное. Так же имейте ввиду что квоты на Н-1В в этом году закончились еще в феврале.

Светлана, я просто выразился утрированно. На самом деле нужно доказать, что за те деньги, которые работадатель предлагает работнику (причем эта зарплата находится under Labor Department survey; работадатель не сможет предложить, например, микрохирургу зарплату в 10 долларов в час) американский работадатель не может найти американского работника. То есть мы, конечно же, говорим не о заменимости (как какого-то таланта, например), а о не возможности найти "согласного" среди американских граждан или резидентов. Они же всегда заботятся о том, чтобы, ни дай Бог, не дискриминировали американских работников. Так что если будут согласные американцы на эту работу, то нашему герою визы не видать.

Да полно Вам, Лев. Можно подумать, что на места H-1Bшников из России нельзя найти квалифицированных американцев. Компании пишут позиции под конкретных людей, которых они хотят нанять и никакой сложности тут нет.

Вполне согласен, что "пишут". Ну и как много "программеров" Вы знаете, которые бы получили визу в этом году? Тем более, мы говорим о тех, пусть даже "программерах", которые живут заграницей.

Про этот конкретный год -не знаю. Но ещё пару лет назад, получить раб.визу, имея опыт работы, было относительно нетрудно. Еще более легко было полyчить контракт, имея "блат" у работодателя (впрочем, это также относится и к американцам)

Lev, vy prosto chush' nesete. There is absolutely no requirement to prove anything about the capabilities or the availability of US workers. The only thing the employer must be able to document is that the position qualifies as a specialty occupation in that it requires a bachelor's degree or its equivalent, at a minimum, that the prospective foreign national employee holds at least a bachelor's or its equivalent in a relevant field of study and that the the employer will be paying the foreign national employee the prevailing wage for that position, whatever that might be for the geographical area. There are thousands of programmers and systems analysts and software engineers who continue to get H-1B visas every year and I don't know what you are talking about but we, lawyers, are preparing and submitting and getting these approved all the time.

Не знаю как у вас в Калифорнии но у нас в Новой Англии последнии 2-3 года как то больше "духовные" профессии в спросе - повара, швеи, артисты. К сожалению многие из програмистов имея Н1 так и тормознулись по середине Labor Cert. процесса. Правда некоторые вернувшиеся мне пишут что теперь там американским аутсорсингом занимаются. И делают те же деньги что делали в Штатах. 8O Пойди разберись....

Labor Condition Applications and Requirements for Employers Using Nonimmigrants on H-1B Visas in Specialty Occupations and as Fashion Models; Labor Certification Process for Permanent Employment of Aliens in the United States lists of all the criteria which the Department would find meet the statutory test in the event of an investigation.
The Department also wishes to specifically caution against recruitment practices and selection criteria or practices which have the effect of discriminating against U.S. workers or other groups of workers, as the comment by Miano recognizes. In this connection, workers are advised that the three federal agencies ordinarily recognized as responsible for enforcement of anti-discrimination laws are the Equal Employment Opportunity Commission (EEOC), the Department of Justice's Office of Special Counsel (OSC), and the Department of Labor's Office of Federal Contract Compliance Programs (OFCCP).
In the Department's view, an employer's recruitment obligation attaches to the position for which an H-1B worker is sought in the United States (the employer is obliged to take, in the words of the statute, ``good faith steps to recruit . . . United States workers for the job for which the [H-1B worker(s)] is or are sought''). Additionally, the employer is required to offer the job to the U.S. worker if the worker is at least as qualified as the H-1B worker. Accordingly, the focus must be on the particular job(s) in the United States which is/are covered by the LCA, not the position an H-1B applicant already occupies or will occupy with the dependent employer. An employer will fail to meet its recruitment obligation if it utilizes recruitment/selection criteria that have the effect of precluding an equally or better qualified U.S. worker from being hired for the position. The Department also notes that L visas, where the criteria are met, may be available as an alternative method to accommodate intra-company transfers.

You do not need to quote 4 year old memos to me, Lev. I am a licensed practicing immigration attorney and do this work on a daily basis. By the way, are you an attorney or are you just pretending to be? If you are licensed, in what jurisdiction? If you are not, perhaps the Florida Bar Association might like to be aware of the unlicensed practice of law by your business?!
